Agreement
These terms apply to your use of https://clanewenglandtile.com, operated by CLA New England Tile of Pepperell, MA. By using the site or submitting a form you accept them. If you do not accept them, please do not use the site.
What this website is
This site describes services we offer and lets you request an estimate. Nothing on it is a quote, a contract or a binding offer. Prices, timelines and availability are only firm once they are in a written scope signed for your specific project.
Estimates
Estimates are free and carry no obligation. An estimate is based on what was visible and what you told us at the time. Conditions found after demolition, such as water damage, failed substrate, unlevel framing or work done by others that has to be corrected, can change scope and price. When that happens we tell you before we continue, not after.
We do not give prices by text message or over the phone for work we have not seen.
Warranties
We warrant our workmanship for one year from completion. We warrant wet areas against leaks for five years, and that warranty applies only where we installed the waterproofing ourselves from the substrate up. Tile set over waterproofing installed by someone else, or over an existing assembly we were asked to keep, is excluded from the five year term and we will say so in writing before starting.
Our warranties do not cover damage from misuse, from movement or settling of the structure, from work performed by others after we finish, from failure to maintain grout and sealant, or from materials you supplied that fail on their own. Manufacturer warranties on materials belong to the manufacturer.
Licensed trades
Electrical work, plumbing work and permitting are performed by appropriately licensed professionals. We coordinate their scheduling within a project as a convenience to you. Their work is warranted by them under their own license.
Scheduling and access
Start dates depend on weather, on material availability and on access to the property. If you arrange access by key, code or lockbox, you are confirming you have the authority to grant it. We will tell you as early as we can if a date moves.
Materials
Where we source materials for you, we do so at no markup as a service. Natural stone and tile vary between production runs and dye lots, and variation in colour, veining and shade is a property of the material, not a defect.
Photography
Every project photograph on this site is from work we performed. We may photograph completed work for our portfolio. Tell us if you would rather we did not, and we will not.
Content and intellectual property
The text, photographs and marks on this site belong to CLA New England Tile and may not be copied or reused without written permission.
Limitation of liability
To the extent the law allows, our liability arising from this website is limited to the amount you paid us for the work at issue. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot be limited under Massachusetts law.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, and any dispute will be heard in the courts of that Commonwealth.
Changes
We may update these terms. The version posted here with its date is the one that applies.
